Construction Defect

We have extensive experience handling a wide variety of residential and commercial construction defect cases involving everything from retaining wall failures, mud slides, subsidence, improper waterproofing and water intrusion, loss of lateral support and construction delay related claims.  These cases often include a cause of action for Disgorgement under Bus. & Prof. Code §7031 for failure to obtain or maintain a contractor’s license with the Contractors State License Board during any portion of the project.  This can result in the denial of further payment obligations to a contractor and more significantly, a contractor’s obligation to repay ALL of what an owner paid the contractor.  The claims can result in the recovery of prevailing party attorney fees and costs of litigation.  We further utilize top of the line construction consultants and experts and endeavor to informally resolve many of these disputes through mediation.
