Professional Experience

Missy Griffin is a partner in the San Jose office of Gibbs Giden where she represents clients in the areas of construction claims and litigation in addition to business and commercial litigation. Ms. Griffin has worked on complex construction litigation for private and public works, contract drafting and analysis, delay and disruption claims, construction defects, and mechanics lien and stop payment foreclosure actions. Ms. Griffin participates in legal matters throughout the entire course of the case, from the initial pleading stage, discovery, law and motion work, case management and motion hearings, pre-trial preparation and through trial, and has obtained favorable settlements and results. Ms. Griffin also drafts various construction contracts, including prime contracts, subcontracts, master agreements, purchase orders, and related documents and forms.

Ms. Griffin is an Adjunct Professor and a member of the Dean’s Council at Pepperdine Caruso School of Law, and an active member of the American Bar Association (ABA) Forum on Construction Law, the largest association of construction lawyers in the world.

Ms. Griffin brings to Gibbs Giden nearly a decade of real estate and property management experience. Prior to becoming an attorney, she worked in operations for a leading multifamily residential company on the West Coast followed by positions in operations and human resources for the largest owner and operator of premium showroom and exhibition space for the home furnishings industry.

Representative Matters

  • Hotel Project Arbitration: Represented subcontractor against general contractor in 10-day arbitration involving payment dispute and alleged delay damages. Successfully defeated entire $2.4 million claim and achieved favorable award for affirmative claim, including attorneys’ fees.  
  • Hotel Project Arbitration: Represented ENR-ranked general contractor in arbitration regarding payment dispute and poor workmanship against subcontractor. Successfully defended nearly $1 million claim.  
  • Public Works Dispute: Represented ENR-recognized general contractor in $29 million claim against public entity for payment and delay disputes related to ground-up construction. Achieved favorable settlement against public entity owner and successfully negotiated claim of major electrical subcontractor involved on the project.
  • High-Rise Renovation Dispute: Represented ENR Top 400 general contractor in $27 million litigation involving breach of contract, delay claims, and issues related to asbestos containment / abatement. Achieved favorable settlement against developer and several subcontractors on the eve of a month-long arbitration.
  • High-End Residential Development Dispute: Represented nationally recognized owner-developer in construction defect dispute against the architect and multiple subcontractors; achieved favorable settlement in excess of $4 million.
  • Hospital Wing Addition Dispute: Represented ENR-ranked specialty subcontractor in $67 million claim by general contractor involving breach of contract, negligence, delay claims, and multiple other subcontractors, design professional entities, and insurance carriers. Achieved favorable settlement against general contractor.
  • Transit Project: Represented ENR Top 500 design firm in $100 million+ dispute involving breach of contract and design dispute related to light rail project. Achieved favorable settlement against general contractor.
  • Other Matters: represent both public and private entity owners, developers, general contractors, subcontractors, and suppliers in disputes involving breach of contract, delay disputes, payment disputes, mechanics lien and stop payment notice actions, payment bond claims, contract negotiation, and project closeout, among others, on project including high-rise commercial buildings, high-end multi-family housing, medical facilities, banks, hospitals, hotels, courthouses, water treatment plants, data centers, agricultural facilities, clean rooms, light-rail, and more, in litigation and arbitration venues.
