Professional Experience

Austin K. F. Benner is a litigator focused on large-scale construction disputes, with particular emphasis representing civil engineers in infrastructure megaproject litigation.  His practice also draws upon a strong background in international law and international trade, allowing him to approach complex commercial disputes with a broader understanding of global regulatory frameworks, economic policy, and cross-border business considerations.

Austin is adept at navigating high-stakes, technically sophisticated litigation.  He brings substantial trial experience, including multiple jury trial victories, and he has successfully obtained summary judgment relief on behalf of clients in complex litigation matters,

Austin approaches each matter with precision and strategic foresight, applying a keen economic lens to evaluate what constitutes a true win for the client and to chart the most efficient, value-maximizing path to achieve it.  He distills complex factual and engineering issues into compelling legal narratives to position cases for favorable resolution.  He is particularly effective at advancing arguments at the leading edge of the law, thoughtfully operating in areas where the governing framework is unsettled or undeveloped—where the law is not yet written to encompass the nuances of the case, and the combination of significant amounts in dispute and highly complex subject matter rewards counsel capable of optimally shaping it.

Outside of his work on infrastructure matters, Austin enjoys off-roading, where he explores environments far removed from the systems he litigates.
